Description
Petitioners
William de Montagu, Earl of Salisbury.
Name(s)
de Montagu, Earl of Salisbury, William
Addressees
King.
Nature of request
William de Montagu, Earl of Salisbury states that although the king granted to his father, William de Montagu, Earl of Salisbury, and to the heirs of his body, the castle, town and honour of Denbigh, the cantrefs of Rhos, Rhufoniog and Ceinmeirch, and the commote of Dinmael, with appurtenances in Wales, Roger de Mortimer recovered these from him, as kinsman and heir of Roger, late Earl of March, under the name of the land of Denbigh: and there was an error in the process and judgment. The judgment was executed in the twenty-eighth year of the king's reign, but he has never received any compensation for these lands, although the king had promised him by his charter that he would. He has sued from parliament to parliament since his loss, and in the parliament held at Westminster on 8 November in the forty-sixth year of the king's reign, his petition was endorsed that justice would be done for both parties when the heir was of age. The petition he submitted to the last parliament, held at Westminster on 23 November in the forty-seventh year of the king's reign, has not been answered, but the heir, Edmund de Mortimer, Earl of March, is now of age. He requests that the king order the record to be brought before him and his council in the present parliament, call Edmund and other necessary people, examine the record and charters, and ordain a remedy. If an error is found, he asks for the judgement to be annulled, and that he might be restored to his possessions with the issues, or, if the judgment is confirmed, he asks for compensation, in money or some other manner, to the same value, and that of the annual value of the lands since he lost them.

Note
If the last parliament was that of 23 November 47 Edward III (1373), this petition would presumably have been submitted to the next parliament, that of 28 April 1376, and the petitioner is clearly addressing Edward III, as he speaks of the grant 'which you made to my father'. However, two notes on the dorse, one apparently contemporary or nearly so, and one probably later, ascribe this to the first year of the reign of Richard II: the 'contemporary' one saying 'Petitiones de parliamento anno Imo finiente', and the 'later' one saying 'An I R 2'. Possibly the petition was not answered when it was submitted, and was held over into the next reign?Rot. Parl. vol. III, pp.38a-39a is from 1378; Rot. Parl. vol. III, p.58b-60b from 1379; Rot. Parl. vol. III, p.75b-78a from 1380; and Rot. Parl. vol. III, p.352b-353a from 1397.
