Reference
SC 8/18/874
Date
[1307-1327]
Description
Petitioners
Thomas de Swinburn, son and heir of Margaret de Swinburn, wife of Robert de Swinburn.
Name(s)
de Swinburn, Thomas
Addressees
King and council.
Nature of request
Thomas, the son and heir of Margaret, wife of Robert de Swinburn, states that a note was levied in the court of King Edward, the present king's father, in the thirty-fifth year of his reign, between Robert and Margaret, plaintiffs, and Thomas de Holbeck and Avice his wife, deforciants, concerning certain tenements in Westmorland, and also concerning certain services of certain tenants, named in the note, who have not yet attorned; and Robert sued a writ of attornment by grand distress on the note until he died this year, and he also sued against the heirs of some of the tenants who had died. Now Robert, Margaret, Thomas and Avice are all dead, as are some of the tenants. Thomas de Swinburn requests a writ to have the heirs of Thomas de Holbek and Avice come to take up their part, and also to have the heirs of the tenants come to attorn.
Nature of endorsement
He is to sue before the justices where the note is.
Places mentioned
Westmorland.
People mentioned
Robert de Swinburn, father of the petitioner, Margaret [de Swinburn], mother of the petitioner
Thomas de Holbek (Holbeck)
Avice [de Holbek (Holbeck)], wife of Thomas de Holbeck.
Note
This petition must date from the reign of Edward II, and, in view of the number of people who have died since the note was made, probably from towards the end of that reign, especially as Thomas de Swinburn seems to be the same person who is petitioning in 1327 in SC 8/157/7825: but in the absence of other references, it is impossible to be more specific.
