Reference
SC 8/18/872
Date
[c. 1327]
Description
Petitioners
John le Taverner, formerly Mayor of Bristol; Robert Martin, burgess and commmon clerk of Bristol.
Name(s)
Taverner; Martin, John; Robert
Addressees
King.
Occupation
Mayor of Bristol; commmon clerk of Bristol
Nature of request
John le Taverner and Robert state that at the procurement of Bartholomew de Badlesmere, their enemy, Henry le Spigurnel and other justices were assigned by Edward II to hear and determine (oyer and terminer) certain felonies and trespasses allegedly committed by them in Bristol, contrary to the franchise of the city. The justices proceeded, but John and Robert did not come to Gloucester to answer before them. The sheriff returned that they could not be found and had no goods in Bristol by which they could be distrained - which was not true - and they were put in exigent and outlawed, and their goods forfeited, but were later pardoned by Edward II, and their goods restored by charter. They request that the king annul the outlawry pronounced against them, as they have suffered as a result of it for fifteen years and more, or that Geoffrey Lescrop and his companions, justices of King's Bench, examine the record and process of the outlawry in the present parliament, and proceed to judgment on the errors in it.
Nature of endorsement
A writ is to be sent to the justices appointed to hold the king's pleas that, when they have examined the record and process, if they find an error they are to proceed swiftly to annul the outlawry.
Places mentioned
Bristud (Bristol), [Gloucestershire]
Gloucester, [Gloucestershire].
People mentioned
[Edward II], King of England
Bartholomew de Badesmere Badlesmere)
Henry le Spigurnel, justice
Sheriff of Gloucestershire
Geoffrey Lescrop (le Scrope)
Earl of Gloucester.
Note
The petition summarized in Rot. Parl. Hac. Ined. p.156 and in Rot. Parl. vol. II, p.434a, no.45 appears to be similar but not the same: it is included on a roll of petitions from 1327, and so this petition might date from around the same time. However, the very elaborate language suggests that it is considerably later - although obviously still from the reign of Edward III. Taverner was the mayor and leader of the Bristol rebels in the troubles of 1313-16, after which he was banished by Edward II.
