The Abbot and Convent of Thornton state that Thomas, formerly Abbot of Thornton recovered various tenements in Carlton against Gervase Avenel and Joan his wife, before William de Bereford and his companions, justices of the Common Bench, in the tenth year of the reign of the king's father, and that he was later disseised of them by John Walwayn, escheator south of the Trent, because Hugh le Despenser had told him that Gervase and Joan were adherents of the Scots; they remained in Hugh's hands until he was forfeited, and then were taken into the king's hand. In the parliament of the first year of the king's reign, William de Gresseby, the abbot's immediate predecessor, sued for restitution of these tenements; as a result, Henry de Fenton, John Daubenay and John de Crosholm the younger were ordered to hold an inquisition. This found, among other things, that Gervase and Joan were in the king's faith on the day when the writ of right was brought against them, and on the day when judgment was brought on the same writ. And now the same lands and tenements, under the name of the manor of Carlton, have been seized into the king's hand again because Walter de Kelby, the escheator, claims to have found by inquisition that Gervase and Joan were adherents of the Scots. They request restitution of the tenements.
Nature of endorsement
This petition is to be delivered into Chancery, and the abbot is to be heard there and the escheator called and what he wishes to say for the king heard. And the judgment of parliament of which the petition makes mention is to be heard, and the process made on it, as is alleged by the petition, if it is found that what the petition claims is true, then the king's hand is to be removed, if the manor is in the king's hand for the aforesaid reason, saving always to the king his right, if he has any for another reason.
