Description
Petitioners
William de Praers, sheriff of Cheshire.
Name(s)
de Praers, William
Addressees
King and council.
Occupation
sheriff of Cheshire
Nature of request
William de Praers, sheriff of Cheshire, states that when the Bishop of Coventry and Lichfield (described as the 'Bishop of Chester') brought an assise of novel disseisin against Hamo de Mascy and others in his county, Hamo challenged the whole jury he empanelled, saying that the sheriff was a procuror and maintainer of the bishop's party. Triers were chosen by the court, who said that the sheriff was a well-wisher and helper of the bishop's party, but not a procuror or maintainer: because of which the judges of the court decided that the executions of the writ should be sent to the coroners rather than to the sheriff. He requests that this judgment be corrected and the execution given to him, so that he might be able to hold his bailiwick in its entirety.
Nature of endorsement
Because the verdict of the triers is contradictory in itself, the Justiciar of Cheshire is to be ordered to institute an inquiry, by twelve worthy men, if the sheriff is a procuror and maintainer of the bishop's party; and if he finds that he is neither, then he is to take back the execution from the coroners and give it back to the sheriff.
Places mentioned
Cheshire.
People mentioned
[Roger Northburgh] Bishop of Coventry and Lichfield
Hamo de Mascy (Massey).
Note
According to the List of Sheriffs, William Praers was sheriff in 1332, and the same or another William de Praers was sheriff in 1349. The note on the guard, referring to an earlier William de Praers who was sheriff 1287-1292 and 1296-1301, is based on a defective list of sheriffs.According to Ormerod, The History of the County Palatine and City of Chester, (1882) vol. I, p.522, the last Hamo de Mascy dies in 15 Edward III (January 1341 - January 1342): this means that this petition must date from 1332.
