Description

William Vaghan (Vaughan); Joan Vaghan (Vaughan), wife of William Vaughan; Walter Herryng (Herring); Margaret Herryng (Herring); John Chiff; Katherine Chiff, wife of John Chiff.

Addressees
King and council.
Nature of request
The petitioners show that they impleaded the earl of Norfolk before the justices of the Bench of the manor of Deddington by a writ of formedon, which manor Giffard gave to John Abel and his wife and their heirs by a fine levied in the king's court. After the death of the Abels, the manor ought to have descended to Joan, Margaret and Katherine their daughters and heiresses. The earl in his plea pleaded before the justices that he ought not to answer without the king because he held the manor of the king's gift by his charter, by which the justices for a long time have surceased the plea to the petitioners' great damage and disinheritance. They request remedy.
Nature of endorsement
It is ordered to the justices that they view the record and process, and proceed in the plea and do justice notwithstanding the allegation, but do not proceed to judgement without the council of the king.
Places mentioned
Deddington, [Oxfordshire].
People mentioned
Thomas de Brotherton, Earl of Norfolk and Marshal of England

Note
Almost certainly dating to 1331, when a writ was sent to the justices to proceed in the case in response to the petition of the petitioners (CCR 1330-3, p.369).
