Crochille shows that he had the vicarage of Ermington by authority of the pope and peaceably held it until Hathelsey gave the chancellor to understand that the prior of Montacute had the presentation as annexed to his temporalities in Ermington, and Crochille was ousted. Crochille appealed to the court of Rome and received a definitive sentence against Hathelsey. Notwithstanding the sentence of excommunication on him, Hathelsey had Crochille imprisoned in the Marshalsea accusing Crochille of contempt for the crown. Crochille requests that if it is the case that the vicarage is spiritual and does not pertain to the king's presentment then he will ratify Crochille's estate and order his delivery from prison; and if it does pertain to the crown that he pardon Crochille for making his contempt by error by his just ignorance and not by machination, and order his deliverance from prison so that he does not die there from lack of sustenance.

This is dated to 1348 by the details given in Rot. Parl., vol II, p.175; see also PROME, parliament of January-February 1348, appendix, no. 17. However the king presented Crochille to the vicarage of Ermington on 1 October 1352, when it is specifically stated that it was in the king's gift by reason of the priory of Montacute being in his hands on account of the war with France. This would seem to be as a result of Crochille suing before the king whereby the king's rights were upheld, but the vicarage was presented to Crochille (CPR 1350-4, p.322). It is likely that this petition must date to 1352.
