Description
Petitioners
Geoffrey de Staunton, son of William de Staunton
Name(s)
de Staunton, Geoffrey
Addressees
King and council.
Nature of request
Geoffrey de Staunton shows that he had brought his writ of formedon against John and Amy, and has for a long time been delayed by defaults, and by essoins for service of the king and in other manners. This delay now to Trinity next coming is to his great damage and disinheritance, so that he requests that the record be read and examined, and it ordered that judgement be given on the plea pleaded at the quinzene of Trinity so that Geoffrey not be longer delayed from his right.
Nature of endorsement
The council is advised that by the law of the land Geoffrey de Staunton who is a stranger to the fine is admissible to the averment which he has because he is not removed from this averment by statute nor by other law, wherefore the court ought to proceed to judgement since the parties have pleaded and are postponed to both parties' peril. And regarding the last point of record where the answer reserved to that if the court adjudged that she ought to answer, she is prepared to do, it is agreed that she is not able to come to another answer by the law of the land nor save any other answer by her protestation from the time that the parties are stayed in judgement as appears by the record of which this petition makes mention. And upon this let there be a writ to the justices of the common bench where the plea is ordering them that they proceed to judgement in the plea according to the judgement and advice notwithstanding the protestations aforesaid.
Places mentioned
Eyleston (Elston), [Nottinghamshire].
People mentioned
John de Staunton de Elston
Amy [de Staunton], wife of John de Staunton.
Note
The petition is dated to 1340 by its presence amongst very lengthy legal proceedings in the roll of parliament of July 1340 (see heading on Rot. Parl., vol II, p.117). This is supported by a writ of 22 May 1340 in accordance with the answer on the petition (CCR 1339-41, pp.408-9): this petition itself was presented in the previous parliament, that of March-May 1340 (see PROME, parliament of March-May 1340, Appendix no. 5).
