Nature of request
The petitioners show that they and their predecessors as prebendaries have held the church of Axminster from time out of memory, as they have shown before the justices of the common bench. However the abbot of Newenham has maliciously brought a writ of quare impedit claiming that the church is vacant. The justices ordered the bishop of Exeter to enquire into the matter, and he found that he could not find if the church was vacant, but that the petitioners had received the fruits as rectors since 26 June 1322. The justices have stayed proceedings and wish the bishop of Exeter to enquire of the matter again despite the petitioners having produced ample evidence of their rights. The petitioners request that the king order the record and process to be found in Chancery, and that they have a writ to the justices that they are not to order the bishop to enquire again of the matter for the damage that it would do.

Note
Although dated to 1335 by the heading in Rot. Parl., vol II, p.90, noting these to be petitions in parliament for 9 Edward III, it is more likely that this petition dates to 1334 as the petition was answered with an inspeximus on the 1 January 1335 (CPR 1334-8, pp.58-9).
