Full description and record details

Reference
SC 8/12/556A
Date
[1334]
Description
Petitioners
David de Strathbogie, Earl of Atholl.
Name(s)
de Strathbogie, Earl of Atholl, David
Addressees
King and council.
Nature of request
The earl requests that he may have livery of the castle, manor and honour of Chilham as the king is obliged to render it to heirs who are within age and in his keeping when they come of age. The earl's father had held Chilham in his life, and died seised of the same when they were taken into the king's hand because of his minority. He had petitioned for their return at the parliament held on Monday after the feast of St Katherine, 4 Edw. III (26 Nov.1330) , but the matter had since been delayed to his disinheritance and great damage.
Nature of endorsement
Let the record which is in Chancery touching this business be viewed and examined by the chancellor, and if it is found that the Lady de Badlesmere was party to the suit that the earl made in Chancery then she is to have a writ and all the process to the land, and if it is found that she was not party to it, that then the chancellor should proceed in the process and do justice according to the judgement previously made in parliament.
Places mentioned
Chilham, Kent.
People mentioned
David [de Strathbogie], Earl of Atholl, father of the petitioner
Lady de Badlesmere.
Note
The petition is dated to 1334 by the heading in Rot. Parl., vol II, p.73, making this part of a section of petitions in parliament in 8 Edward III, though this is a Hale transcript. Strathbogie had certainly forfeited estates by January 1335 (CPR 1334-8, p.61), so the petition may be securely dated to 1334.
