Nature of request
Balle shows that he sued a writ against Collington for land and meadow at Collington which he recovered. Before he could have execution of the judgement Roger Mortimer, late earl of March by his lordship arbitrarily entered the tenements and held them until his death when they forfeited into the king's hand. Balle requests that the king order his justices of the Bench that they make due execution to Balle of the judgement notwithstanding the king's seisin, and that the escheator be ordered to remove his hand, and be discharged.
Nature of endorsement
The record and process of this business are to be brought into Chancery, and if it is found by the record that the judgement was given and not executed then it is to be ordered that the record go before the justices assigned to hold the pleas of the king, and when they have viewed the record and summoned those who are to be summoned, and their reasons heard, they are to do justice.
