Description
Petitioners
John de Tynton.
Name(s)
de Tynton, John
Addressees
King and council
Nature of request
John de Tynton states that he was one of the king's ministers in Bardney abbey during the vacancy when Henry de Thornhagh had custody of it through the king's commission, and that when the former abbot was reinstated by the archbishop of Canterbury, and wished to enter the abbey, they prevented him until he brought the king's writ of entry, in accordance with Henry's commission. The archbishop of Canterbury and his official then impleaded John and his colleagues, and excommunicated them, because they would not let the abbot enter through the archbishop's letter, and, although John has brought the king's prohibition and tried many other legal remedies, he has been unsuccessful, and the archbishop and his official have now had a capias issued to the sheriff of Lincolnshire, to have them arrested and imprisoned. John and the others ask that this capias be repealed.
Nature of endorsement
If he had a prohibition, he is to have an attachment, and if he has sued the attachment he is to have a writ to revoke the capias.

Note
CPR 1301-1307 p. 210 (appointment of Henry de Thornhagh to custody of Bardney abbey) is dated at Dunfermline, 10 February 1304; CPR 1301-1307 p.222 (mandate to Henry of Thornhagh to permit the abbot to have administration of the abbey again) is dated at Stirling, 10 May 1304. This petition must be after the latter date: given the number of legal procedures that have taken place, probably some time afterwards.
