Reference
SC 8/7/338
Date
[1322]
Description
Petitioners
Herbert de Mareys (Marish).
Name(s)
de Mareys (Marish), Herbert
Addressees
King and council.
Nature of request
Herbert de Mareys states that John de Wylyngton wrongly disseised him of Lundy Island in Devon, of which he and his ancestors had been seised from time immemorial; because of which Herbert arraigned an assize of novel disseisin against him and others before John de Foxlee and John de Stonore, the king's justices. He recovered his seisin, and damages, but John de Wylyngton defended the island with force and arms and would not let him have them. Now, because John went against his allegiance to the king, his lands, including Lundy, were seized into the king's hand. Herbert requests a remedy.
Nature of endorsement
The record and process of the assize are to be brought into Chancery, and when they have been seen and examined etc., the king is to be consulted.
Places mentioned
Ille de Londay (Lundy Island), Devon.
People mentioned
John de Wylyngton (Willington)
John de Foxlee (Foxley), justice
John de Stonore (Stonor), justice
Note
One of a collection of petitions published on pages 387ff of Rot. Parl., vol I., which all seem to date from around 1322. This dating is confirmed by PROME, Appendix of Unedited Petitions, 1307-1337, Rotuli Parliamentorum I, pp. 387-415, which dates these petitions to 15 or 16 Edward II (1321-1323).From the reference to John de Wylyngton going against his allegiance to the king, it would seem to date from 1322, but before 20 July 1322, as CPR 1321-4 p.183 is dated at York on that date.
