Description
Petitioners
John de Calewyth son of Richard de Calewyth.
Name(s)
de Calewyth, John
Addressees
King and council.
Nature of request
Calewyth states that Thomas, son of Thomas de Ferers of Loxley, died seised, under age, of half the manor of Great Loxley, in the wardship of the earl of Lancaster, who had given the wardship to Roger de Tissington, who now holds it. They have wrongly maintained John, son of Thomas de Ferrers of Loxley, who is not the heir of the whole blood, but the son of another mother. The wardship ought to be seised into the king's hand because of the minority of John, son of Richard de Calewyth, who is Thomas' kinsman and heir of the whole blood, and who is seventeen years old. He requests a remedy and that the manor might be taken into the king's hand, and that there might be an inquisition to establish that he is the next heir of the whole blood.
Nature of endorsement
He is to sue in Chancery and have a remedy there according to the law of the land.
Places mentioned
Grant Lockesleye (Loxley), [Staffordshire].
People mentioned
Thomas [de Ferers (Ferrers)], son of Thomas de Ferrers of Loxley
[Thomas of Lancaster], earl of Lancaster
Roger de Tissington
John, son of Thomas de Ferers of Loxley
Roger Beler (Beller), keeper of the lands.
Note
One of a collection of petitions published on pages 387ff of Rot. Parl., vol I., which all seem to date from around 1322. This dating is confirmed by PROME, Appendix of Unedited Petitions, 1307-1337, Rotuli Parliamentorum I, pp. 387-415, which dates these petitions to 15 or 16 Edward II (1321-1323). CCR 1323-1327, p.20 is dated at Greenhow 29 August 1323, but mentions that the lands are in the king's hands through the forfeiture of a couple, not mentioned in the petition, who held them of John, son of Thomas de Ferrers, and that he has had his year and day from them.
