Henry de Uphatherle complains that, while he was serving in the war in Scotland, with Hugh le Despenser the elder and under the king's protection, Robert de Prestesbury with force and arms evicted his wife and household from the lands which he holds of the king in Up Hatherley, destroyed the buildings there, and carried off the building materials for his own use at his own house of Prestbury. When Henry returned home, Robert and Thomas de Hatherlee met him and beat him severely, and have since denied him entry to his own lands, which have been occupied by Robert. Now, however, he has been taken with the contrariants, and is in prison in York, and the lands have been taken into the king's hand; and Henry asks for grace and a remedy, more especially as he was imprisoned for a year in Scotland, and had to pay forty pounds for his ransom.

The petition dates to 1322 as the petitioner refers to a forfeiture as a consequence of an opponent being with the contrariants, meaning the baronial rebels defeated at Boroughbridge in 1322. One of a collection of petitions published on pages 387ff of Rot. Parl., vol I., dated to 1321-1322. PROME::Appendix of Unedited Petitions, 1307-1337, Rot. Parl., vol. I, pp. 387-415 confirms that they appear to belong to these years.
