Description
Petitioners
Maud de Rabayne, widow of Ellis de Rabayne, and wife of Piers Malorre (Mallory).
Name(s)
de Rabayne; de Rabayne; Malorre; Mallory, Maud; Ellis; Piers
Addressees
King and council.
Nature of request
Rabayne requests that the king order that the record and process of her suit be brought before his council, and her reason be heard, and right be done to her concerning her claims to the barony of Bayouse (Thoresway in Lincolnshire). The barony had been given to her and her late husband Ellis de Rabayne by her father Steven de Bayouse. Their seisin in the barony was interrupted by the claims of Piers Baudrant who claimed a moiety of the barony as the son of Rabayne's sister. He recovered the moiety, and Rabayne disputed this, and the justices who heard it decided to speak to the king about it, and the suit has been delayed.1)
Nature of endorsement
Rabayne should have a writ at common law against the tenant and since he will not come at this and has said that he is not able to respond without the king, then the record and process mentioned in the process should be brought, and justice be done.2) Afterwards, the petition being heard and read in the presence of the great council, and the arguments contained in the petition sewn to the bill being understood, it was seen that Rabayn could not prosecute at common law, and thence she should have a writ to bring the record and process of all the business within written brought before Roger le Brabazon and his associates. They are ordered, the matter having being examined fully, to do full justice.3) Coram magno consilio.
