Nature of request
Falgate requests a remedy so that she is not disinherited of her tenements in Burnham Norton and Burnham Westgate. She shows that Richard Neel and Richard son of John de Asheneye conspired between them to bring a writ of covenant in the name of Falgate and Simon son of Richard Neel against Richard Asheneye for tenements in the two Burnhams which she held. Endorsed on the writ were pledges for Falgate to sue, and a fine was engrossed made before the king's justices at Westminster in the 3rd week of Michaelmas, 5 Edw. II by which Asheney acknowledged the right of Simon and rendered the same tenements to Simon and Falgate to hold to them and Simon's heirs forever. However Falgate knew nothing of this, and instead some unknown woman took her place, in deceit of the court. They retained the writ until the year had passed so that Falgate had insufficient warning to put in her claim.
Nature of endorsement
She should sue in Chancery and have a writ to the justices in whose presence the fine was levied, and they are ordered to do justice on the contents of the petition, and the other parties to the fine are to be called before them.
