Description
Petitioners
Robert de Monhaut.
Name(s)
de Monhaut, Robert
Addressees
King
Nature of request
Monhaut states that his father Robert died seised of lands and tenements in Ewloe which pertain to the castle of Hawarden in the county of Chester. Following the death of his father the lands came into the king's hand by the minority of Roger de Monhaut, son and heir of Robert, and Joan widow of Robert received a third of the lands as dower. The remaining two thirds were returned to Roger de Monhaut when he came of age, and he was consequently seised of the two thirds as his inheritance, and of the other third after the death of Joan. However Reginald Grey, then justiciar of Chester without judgement ousted Roger de Monhaut, who sued before the king, the present king's father, to have the land out of the king's hand. But Roger de Monhaut died before he could complete his suit. By Roger de Monhaut's death Monhaut as his brother's heir has sued from time to time, and parliament to parliament, but his suit has been delayed and disturbed by the Scottish war and other business of the king. Monhaut requests that the king has regard for his right and his long suit. He also requests that it be remembered that when Monhaut was with the king in his service in Scotland, the king promised him his lands.
Nature of endorsement
Because the tenements mentioned in the petition are in the hand of Lord Edward, son of the king, earl of Chester by the king's gift, the king commands the earl or his justiciar of Chester, to summon his councillors of those parts, and similarly John de Grey, and they should be advised and informed by an inquisition or by another expedient manner to examine the rights of the king, earl and Monhaut in the same land, and of the cause of the taking of the tenements into the king's hands. And it was ordered that a writ of the king be sent to John de Grey, justiciar of North Wales, son and heir of Reginald Grey late justiciar of Chester (who seized the lands into the king's hands) as John de Grey can inform the earl and his council of the other circumstances touching this business. The king is to be informed by the earl or his justiciar of Chester so that he can properly respond to the petition.
