Description
Petitioners
Richard de la Chambre (Chamber), parson of the church of Leigh.
Name(s)
Chambre (Chamber), Richard
Addressees
King
Occupation
parson of the church of Leigh
Nature of request
1) Chambre states that whereas Edmund, earl of Arundel and his bailiffs by force of arms disseised him of £60 worth of land in the franchise of Oswestry in the Welsh march. They took by force and arms out of the county 80 oxen, 100 cows, 20 horses, 800 wethers, 400 ewes, 100 pigs and 100 goats and other goods and chattels to the value of 200 marks, and they took them away against the peace. And the king in response to Chambre's petition previously submitted in council ordered by divers writs to the earl that he make redress for those hardships or signify to the king the reason as to why he does not wish to make redress. The earl having received the writs does not wish to make redress, but has not signified the reason why, so that Chambre requests that the king order his justices should go there and take the assize and hear and determine (oyer and terminer) the trespasses.2) Chambre further requests to have the justices Hugh D'Audley, justice of North Wales, William Inge, John de Foxley, Robert de Staundon, William Wyther or two or three of them.3) Chambre further states that Richard de la Chambre father of the petitioner was taken by the earl by force and arms from Oswestry and imprisoned because Chambre made suit in those courts for the hardships the earl had inflicted on him. And afterwards the earl wrongly indicted him of the deaths of five men who were felons of the king in the war against David of Wales, by which indictment he is even now detained in prison. Chambre again recites that the king has ordered divers writs to the earl to make redress or explain why he does not wish to do so, to which he has not signified any reason why he does not wish to make redress Chambre again requests the intervention of the king's justices to hear and determine (oyer and terminer) these trespasses, and that the council order that he be delivered from prison to sue his complaint.
Nature of endorsement
Hugh de Audeley, William Inge, Robert de Staundon and William Wyther or two or three of them in default of the earl are to be assigned to hold the assize, and hearing and determining (oyer and terminer) the complaints as long as William Inge is one of them. And in regard to the contempt of the earl, they are to give him a day to come before the king to answer on it. And writs are to be sent to the sheriff of Shropshire that he bring the parties before the justices, and similarly writs are to be sent to the bailiffs of the neighbouring liberties (Overton, Montgomery, Whittington and Ellesmere) to make appear as many upright and law-worthy men from their bailiwicks. And another writ is to be sent to the sheriff that he should personally come to the liberty of Oswestry and enter it, and when he has accepted the mainprise of Richard de Chambre senior that he will appear before the justice and prosecute his case, then he is to be delivered from prison. And another writ under an earlier date is to be sent to the earl that on a certain day and place that the justices will make known, in their presence he is still to do justice, otherwise the justices are to proceed on these matters according to the form of their commission.
