Report of Marmaduke Constable on 1 individual petition (prisoner) and 1 collective petition/reference (19 people, from Camberwell and Southwark in Surrey, Kentish Town and Whitechapel in Middlesex and the Strand, Barbican and other parts of London) on behalf of John Smith alias John McPhail, publican and broker in London, convicted at the last Michaelmas Yorkshire North Riding Quarter Sessions at Beverley on 5 October 1790, for obtaining money by false pretences, from Thomas Turner. Grounds for clemency: previous good character (including reference of ex-employers), promise of future good behaviour, has a wife and 4 children to maintain, business difficulties had led him towards the crime and has relatives in Jamaica where he may regain his good character (this was stated by his uncle in the court prior to sentence). Initial sentence: 7 years transportation. Recommendation: to transport himself to Jamaica for the remainder of his sentence.
