Report of Berkeley Burland, Chairman of the Somerset Quarter Sessions, on James Sparrow, convicted (indicted with John Cooper; acquitted) at the Somerset Quarter Sessions at Wells, for stealing 5lbs of lead fixed to a dwelling house, property of John Lacey, of Frome Selwood, on 27 or 28 January 'last'. There is also an account of the trial extracted from Burland' minutes. Evidences supplied by Timothy Lacey and George Kingdom, servant to William Shepherd and the prisoner. Grounds for clemency: previous good character, has a wife and family to keep which he had previously done through his own trade and work, the magistrate was unsure of his guilt and wanted the jury to acquit the prisoner, the court would (if there had been any discretion with the act) have provided a lesser sentence as the amount of lead stolen was 'very small'. Initial sentence: transportation. Recommendation: mercy (to remain in prison until the next set of transportees are removed).
