Report of John William Rose, Recorder of London, on 1 collective petition (in his wife's name - 13 people, from London/Westminster) on behalf of John Marlbrough, convicted at the Old Bailey in May 1790, for receiving 8 bushels of oats, value 14/-, property of Richard Mountain, on 1 May 1790. Samuel Palmer, carman or trouncer, convicted of the theft and sentenced to 7 years transportation. Evidences supplied by Richard Hodges, wharfinger at Northumberland Wharf; William Darmer, cooper; Robert Stevens, carman from Coal Wharf; Walter Blackhall, carman for Mr Hodges; Thomas Hodges and Richard Mountain. The judge describes the case as 'Injurious to Society'. Grounds for clemency: has long supported his family by industry, has a wife and 4 children (the youngest not 12 weeks old) now deprived of support, had fallen into bad company (duped by another) who claimed the goods were 'sweepings' and thus a perquisite, and was recommended to mercy by the jury. Initial sentence: 14 years transportation. Recommendation: no mercy.
