Description

Report of John William Rose, Recorder of London, on Moses Harris, convicted in December 1788 for stealing a cotton counterpane. Grounds for clemency: guilt was admitted and was his first offence. Initial sentence: 7 years transportation. Recommendation: that he transports himself for the period of his sentence and security is found in 2 responsible people for £100.

There is also a letter, dated 11 August 1789, from Rose to William Grenville clarifying the definition of conditional pardons. He had received a pardon for Moses Harris and George Williams, which he intends to action, since they were to find security to leave the Kingdom and not return. If the prisoner does return within the term the original capital sentence applies. He quotes the required wording of the pardon, '"On condition that the said prisoner shall depart this Kingdom within a month from the day of his discharge and shall not return or be found within the Kingdoms of Great Britain or Ireland for the term of [blank] years to be computed from the day of his conviction and that he find sufficient securities for the performance of the aforesaid condition or conditions, as it may be". If the prisoner returns he breaks the condition of his pardon and cannot offer that pardon in evidence but must submit to suffer the Law for a capital crime'.
