Report of James Adair, Recorder of London, on:
1. John Wintersgale, convicted for petty larceny. A report had been submitted at an earlier date. Grounds for clemency: although there were no new circumstances that could influence the judge to alter his opinion other factors influenced the state of execution of sentence as the offence was not grave enough to warrant transportation to Africa and there was no other place fixed by the Government, to which the prisoner could be sent, considering the overcrowded state of Newgate prison the prisoner could not be sent there. Initial sentence: 7 years transportation. Recommendation: to transport himself for the period of his sentence.
2. Ann Smith, convicted for stealing 12 handkerchiefs in the shop of Richard Wilcox, tradesman. Grounds for clemency: none given. Initial sentence: not given. Recommendation: mercy on condition that the parties applying on her behalf produce an authentic certificate from the Keeper of the house of correction stating her poor health; otherwise speaks against mercy.
