Report of Edward Willes on James Halyburton, convicted at the Derbyshire Assizes of the rape of Millicent Smith, wife of Charles Smith, farmer, on 26 July. An earlier letter states that the prisoner has been respited to allow time for the receipt and consideration of this report. Smith had been married for 19 years, had 8 children and was pregnant with another. She was returning from Wirksworth when she was stopped on the road. Evidences supplied by Millicent Smith, Elizabeth Wayne/Wagner and Captains Cox and Pratt. Grounds for clemency: was innocent and of previous good character who had been a brave and useful soldier in their Regiment for 6 years, 4 as a common soldier and 2 as corporal. Initial sentence: death. Recommendation: although he 'would not wish to prevent his majesty shewing mercy to a brave soldier' [but] 'I cannot venture to recommend him'.
