Folios 55-56. Attorney General from Lincolns Inn to Newcastle. Private report upon the question concerning the capacity of any Gentlemen who shoud be appointed Commissaries pursuant to the Treaty of Seville, to hold their seats in the House of Commons. Is of opinion, based upon the practice of Parliament in like cases, as in the case of Sir Joseph Martin, who was appointed a Commissary in 1713 in pursuance of the Treaty of Utrecht; that if the Gentlemen to be appointed Commissaries, should be members of the House of Commons, their seats would not be voided.
