Folios 149-150. --------- to Lord Chief Justice. Petitions being frequently presented to the King for pardons to persons convicted of capital crimes before the judges in their several circuits, which are of course referred to them as best able to inform his Majesty how far such criminals may be proper objects of mercy. His Majesty to prevent the trouble given by such applications, has commanded me to signify to your lordship to be communciated to the rest of the judges, his Majesty's pleasure that you do not in your circuits appoint an unusual distant time for the execution of those criminals or grant them reprieves, unless it be in cases where you conceive that his Majesty's goodness and mercy may fitly be extended to them, either by a free pardon or by one on condition of transportation, of which, at your return from your respective circuits, you will please each of you to send to one of the Secretarys of State to be laid before his Majesty a particular list distinguishing therein those whom you shall judge proper to be freely pardoned, and those who in your opinion should be transported to his Majestys plantations, according to the Act of Parliament in that behalf.
