(i) Extract from the records and acts of parliament [cf. Acts Parlt. Scot. vi, pt. 2, p.449a]. The estates of parliament, considering how necessary it is for the peace and good of the kingdom to have justices of the peace again established in the Scottish shires and jurisdictions, have renewed and ratified the act of 1617 [cf. f.186], and appoint nine or ten persons [named] to hold that office in the shire and jurisdiction of Lanark. They are granted full power to administer justice and to impose and exact fines, etc. The clauses requiring justices of the peace to account to the Exchequer, and the Exchequer to grant fees and expenses to the constables, are rescinded, and the justices of the peace are to be accountable to the parliament or committee of estates, paying charges and expenses out of the fines as they think best. Until the act is rectified the justices of the peace are to proceed in accordance with the act of 1617. The extract was made by Sir Archibald Johnstone of Warriston, clerk register.
