Description

(i) Obligation concerning a loan of 8,000 marks Scots to Sir William Dick of Braid by Jean Campbell, widow of Robert Dunbar of Burgie, 'in name of' Ninian Dunbar (Dumbar) of Grangehill, tutor dative [executor/legal guardian or administrator of estate appointed by a court when none has been nominated by the testator] to Patrick Dunbar of Westerto[? w]n. Dick, with his sons Master Andrew, William and Master Alexander Dick as sureties, contracts to repay the principal, with £800 'expenses' in case of default, within fifteen days after Candlemas 1643, or to pay the statutory interest for any period after the agreed date of payment during which the debt remains unpaid. Sir William promises to save his sureties harmless in case of default and they make the same promise to any others who may become involved. The Dicks consent to registration of the obligation in the books of council and session, to have the force of a decree allowing for the penalties of horning, etc., and appoint [blank] their procurators. The document was written by George Heriot (Hereott), servant to Richard Guthrie, writer to the signet. The witnesses are Sir William's servants Alexander Dick and Alexander Stewart, George Heriot the writer and Robert Dunbar, servant to Jean Campbell. [Signed by] the principal debtor, sureties and witnesses. [Endorsed, in three hands, number 2 that of the original document]: Edinburgh, 29 July 1642. (ii) 1. The procurator [unnamed] for the Dicks appeared and consented to registration of the obligation. 2. Names of the chief contracting parties. '1642'. Edinburgh, 6 June [?1644 or 1649]. (iii) 3. 'Registrat ob. Dumbar Dickis'. 6 June [?1644 or 1649]
