Obligation by Master Patrick Hamilton, parson of Cambuslang, concerning a loan of 205 marks Scots from Archibald Hamilton of Kirktown, Alexander Wilson of Whitehill and Adam Paterson of Duncanrig, curators for John Littlejohn, son of Andrew Littlejohn, deceased, of [? park of] Blantyre. Twenty marks' annual interest is to be paid on the loan from Martinmas 1634 to Martinmas 1635, the promised date of repayment. The debtor's sureties are Robert Millar of Clydesmill and John Small of [? Croketshiell]. Further agreed payments are a £40 penalty in case of default and 10 interest for any period after the date for repayment. The debtor contracts to save his sureties harmless, and he and they consent to have the obligation registered in the act book of the lords of council and session or the sheriff's court book of Lanark, to have the strength of a decree allowing for the penalties of horning, etc. They appoint [blank] their procurators. The witnesses are two named Robert Hamilton, John Millar, senior of Mylnhauch and John Millar his son. The document was written by Robert Fleming, notary at Kilbride kirk. [Signed]: [? M.] Cambuslang. Robert Millar. Marginal note [in different hand] that the procurator [name illegible] for the debtor and sureties appeared and consented to registration [presumably in the books of council and session]. [Followed by] Additions [in several hands]: 1. Statement by John Small that his hand was 'at the pen led' by Robert Fleming, since he cannot write. 2. Statement by Fleming, verifying 1. Latin. 3. Statement that [? Jeremiah Craig, attorney, gave his testimony]. Latin. 4. Signatures of the four witnesses. [Endorsed, in yet another hand]: 'Oblig. Hamiltoun [? contra Hamiltoun] Dec. 1635'. primo
