Four commissioners have been asked to adjudicate on the charges brought by Mr. Cornelius Ainslie, executor dative for Alexander Home (who died on [blank] August 1634), son to Gavin Home of Johniscleuch, deceased. Ainslie has licence from the commissioners to collect debts owed to the estate by Alexander's brother Archibald Home. A long and detailed list of these is given, the majority being annual rents and tithes from various properties, some in the sheriffdom of Berwick and near the town of North Berwick, others at Cleghorn, allegedly received by Archibald Home, who has not accounted for them to Ainslie. Among other items Ainslie claims that the defender has collected, or should have done so [? as next of kin to Alexander], large sums from Sir John Home of North Berwick, apparently following a decree by the lords of council and session on [blank] July 1630, and a further amount, at least 1,000 marks from Sir John Auchmowtie of [? Gosford] at Whit Sunday 1633. The total sum owing is ... [Remainder of M.S. torn off. The whole is badly torn and in poor condition]. Dated at Edinburgh.
