Description

(i) Royal order to [blank], messengers, sheriffs in hac parte. Sir Robert Richardson of Pencaithland, knight and baronet, received from the subcommissioners of the presbytery of Haddington a decree of valuation of the tithes on his property in Pencaitland and elsewhere in the constabulary of Haddington and sheriffdom of Edinburgh. [cf. f.160]. It is necessary that this shall be ratified by 'the lords and uthers of oure commission', for clarification of Richardson's liability for tithes and in order that the church may be sufficiently provided. The sheriffs are therefore to summon John, earl of Mar and various 'life-reuters' of the tithes [unnamed], together with Master John Oswald, minister of Pencaitland, and all others [unnamed] having or pretending an interest in the matter, to appear 'before us or the said lords of our commission' on 11 December [date in different hand], to answer at the pursuer's instance and to see the sub-commissioners' valuation ratified, or to show reasonable cause why this should not be done. If the defenders do not attend the hearing the lords will approve the ratification. Notarial sign. [Illegible signature: ? - Hay] Seal. '28 Noris 1633'. Edinburgh, 25 November 1633. (ii) Marginal note [in different hand] that 'Culling[? ...]' [? procurator for the pursuer] produced the valuation. As [? the defenders] were absent the lords allowed the valuation. [Endorsed]: 1. By Thomas Norie, sheriff in hac parte. On 29 November 1633 he left a copy of the summons with the master porter of the earl of Mar's house at Selyng. Three witnesses [named] to his action. [Signed]: Thomas Norie messinger. Seal, now fragmentary. [Date of hearing here given as 4 December]. 2. [In different hand]: By John Welandes, sheriff in hac parte. On 8 December he personally summoned Mr. John Oswald, and gave him a copy of the summons. Three witnesses [named] to his action. [Signed]: Jo. Welandes messr. Seal, now fragmentary. [Date of hearing here given as 17 December]. 3. [In third hand]: Names of chief parties to the suit. 18 December 1633
