Description

(i) Indenture between the right honourable Master Alexander Mackenzie of Culcowie, heritable proprietor of the towns and lands of Mullochie and Muren in the diocese of Ross and sheriffdom of Inverness, and Master John Mackenzie, archdeacon of Ross, and Kenneth Mackenzie his oldest son and heir apparent, heritable proprietors of the town and lands of 'Meikill Suddie' in the same diocese and sheriffdom. To settle a longstanding controversy about the boundaries of their lands the parties have perambulated the disputed areas and, taking the advice of friends who have subscribed the indenture of witnesses, set up 27 boundary stones reaching to the seacoast; the division is complete except for a small district to be held in common. Both parties agree to the cutting of a dyke between their properties, and promise that they, their tenants and servants will observe good relations. Each quitclaim and discharges the other from all penalties from process of law concerning the existing boundaries, and agrees to have the indenture settling the new ones registered in the books of council and session or the sheriff's books of Inverness, to have the force of a decree allowing for penalties of horning, etc. The parties appoint [blank] their procurators for this purpose. The document was written by Robert [? Wand/Wane] writer in Inverness. [Signed by] all three Mackenzies and six witnesses [named], including the writer. [Endorsed]: 1., 2. [In same hand as each other]. Mullochie, 10 June 1630. (ii) Procurators for both parties consent to registration. [Both unsigned]. 3. [In different hand]: Names of parties. Edinburgh, undated.
