Description

(i) Obligation by John, earl of Atholl, Lord Murray concerning a loan of 2,500 marks Scots from Andrew Ayton (Aytoune) of Logie, advocate. Atholl agrees to 'infest and fee' Ayton, his heirs and assigns, and in default of these 'John Aytoune of that ilk' and his heirs with an annual rent of 250 marks, to be paid from the Atholl estates anywhere in Scotland at Whit Sunday and Martinmas - the first payment to be due on Whit Sunday 1631 - until such times as the principal is repaid. Atholl's sureties, whom he contracts to save harmless should he default, are Mungo [Murray], master of Stormont and James Lyon of Auldbar. A forseiture of [blank] is to be incurred for each default on the annual rent. If Ayton so wishes he may demand payment of the principal on or after Martinmas 1630 by foregoing the annual rent. An extra £300 is provided for in case of default on the principal by Atholl, who with his sureties, agrees to have the obligation registered in the books of council and session, and a decree made by the lords allowing for the penalties of horning, etc. He appoints [blank] as his procurators. The document was written by Mr. Andrew Ayton, servant of the creditor. Four witnesses [named] to the transaction. [Signed by] Atholl, the witnesses and 'Lyone cautioner'. [Endorsed, in three different hands]:, 25 March 1630. (ii) 1. 'Ob. Laird Logie contra Erle Atholl'. 18 March 1634. (iii) 2. Atholl's procurator consents to registration in the books of council and session of the obligation [? produced] by Mr. Andrew Ayton. [Signed;] [? ...ltricairne]. Edinburgh, 18 March 1634. (iv) 3.
