Description

Further documents concerning legal proceedings in the Hamilton case (ff.153-157) [cf. ff.130, 138-141, 143]: (i) Heading: '[? Per] Stewart et her dett'. Extract from the act book of the lords of council and session. The lords have assigned 15 March to Master David Primrose, procurator for the defenders, to bring his clients before the lords to give their oaths of verity about the evidences in the case. If they are absent they will be held to have confessed their guilt, and a decree will be issued against them. [Signed]: W. Scott. Notarial sign. Marginal notes [in different hands]: Edinburgh, 25 February 1630. (ii) 1. Primrose [? promised to bring his clients] on Tuesday to give their oaths. 18 March 1630. (iii) [Torn and partially illegible]: John Mowbray and John Libberton were present. Primrose [? ...] Thomas Edgar [? ...] to give his oath, and asked to be heard again to raise objections. Thomas Inglis will be held to confess his guilt unless he attends the court before [? Saturday]. [Endorsed, 1-3 apparently in same hand as one another]:, 23 March 1630. (iv) 1. John Libberton took his oath of verity, and denied that he possessed or had hidden any documents. [Signed]: Johne Libbertoun 2. Thomas Edgar swore as above. [Signed]: Tho. Edgar. 3. John Mowbray produced various writs, etc. and on oath denied that he possessed any others 'except that he confesses that ...' [next section, damaged, contains reference to a confirmed testament] or had hidden or destroyed any. [Signed]: Jo. Mowbray. [Subscribed]: J. Balcomye. 23 March 1630. (v) 4. Thomas Inglis took his oath of verity and swore as 1. and 2. [Signed]: Thomas Inglis. Mr. Alex. Miresone. 5. Names of chief parties to the suit. 6. [Fragmentary] '...
