Description

Further documents concerning legal proceedings in the Hamilton case (ff.153-157) [cf. ff.130, 138-141, 143]: Royal order to [blank], sheriffs in hac parte. The lords of council and session have assigned 13 February for the four defenders to appear, bringing all relevant documents, and to give their oaths of verity concerning any matters for which written evidence is unavailable. The sheriffs are therefore to summon the defenders, warning them that if they do not attend the hearing they will be held to have confessed their guilt, and a decree will be given against them. [Signed]: A. Stratoun. Seal. Notarial sign. 'Quarto Febrij 1630'. [Endorsed]: 1. By Alexander Stratton, sheriff in hac parte. On 5 February he personally summoned Mowbray, Libberton and Edgar in Edinburgh, and gave to each of them a copy of the summons to appear on 13 February. Three witnesses [named] with 'uthers dyvers' to his actions. [Signed]: A. Stratoun, messr. [Seal, said to be affixed, now missing]. 2. [In same hand as 1.]: By Alexander Stratton. On 9 February he personally summoned Thomas Inglis in Edinburgh, and gave him a copy of the summons. Two witnesses [named] to his action. [Signed by] Stratton. [Seal, said to be affixed, now missing]. 3. [In different hand]: Names of chief to the suit. '1630'. Dated at Edinburgh.
