(i) Royal order to [blank], sheriffs in hac parte, setting out details of the preceding suit [cf. f.99]. Since, even if the arbitrators' decision has now been inserted, the document is invalid, the defenders, who possess the relevant evidences or who have 'fraudfullie put the same away', are to be summoned to appear before the lords of council and session on 22 January, bringing with them the 'submission' and the decree arbitral, if one exists. [Signed]: James. J. Hay. 'xvi Julij 1605'. Seal. Notarial sign. Edinburgh, 13 July 1605. (ii) [Endorsed]: 1. By John Small. On [? 4] January he personally summoned Sir Robert Bruce, and gave him a copy of the summons. Failing to find Wardlaw, he affixed a copy to his house. Three witnesses [named] and others [unnamed] to his actions. Seal. 2. [In same hand as 1.] By Small. On 5 January he personally summoned Sir James Scott, and gave him a copy of the summons. One of the three witnesses [named] is Andrew Scott, servant to Sir James. Seal. 3. Note [in different hand]: 'L. Fingaske contra L. Clakmannand'. [Followed by] several illegible words [probably in yet another hand]. 1606
