Description

Documents concerning legal proceedings: Robert and Duncan Kirkwood against Andrew Kirkwood, Elizabeth [née Leischman] widow of [another] Duncan Kirkwood, and her children James, Euphemia (Eufame) and Marian. (ff. 92-95): Royal order to Andrew Purves, John and James Mcmothe and John Phillip [? s], sheriffs in hac parte, to summon parties to a suit apparently concerning the gift by Lord Crichton of Sanquhar of the chaplaincy [or part of the property] of the chapel of St. Nicholas [cf. f.89], formerly held by William Crichton, and disturbances arising from it. [Incomplete]. [Dirty and torn]. [Endorsed]: 1. By Andrew Purves. On 10 April he summoned David [? Crachton/Crichton] and gave him a copy of the summons. Others [named], including Master John Skene, he could not interview personally, so affixed copies to their dwellingplaces. Several witnesses [named] to his action. [Torn]. 2. By John Mcmothe, sheriff in hac parte. On [date obliterated] he issued an open proclamation at the market cross of Edinburgh summoning Lord Crichton of Sanquhar. Several witnesses [named] to his action. 3. By John Phillip [? s], sheriff in hac parte. On [? 26] April he summoned ... [remainder of entry obliterated]. 4. By James Mcmothe, sheriff in hac parte. On 30 April he affixed a copy of the summons to the market cross of Dumfries, and charged all interested parties to appear. ? Several witnesses to his actions. [Partially obliterated]. Dated at Edinburgh.
