Documents concerning legal proceedings: Robert and Duncan Kirkwood against Andrew Kirkwood, Elizabeth [née Leischman] widow of [another] Duncan Kirkwood, and her children James, Euphemia (Eufame) and Marian. (ff. 92-95): (i) Extract from the act book of the lords of council and session. The pursuers appeared by Master Umphra Blinsel and the defenders by Master Thomas Houper, who claimed that Elizabeth, widow of Duncan Kirkwood, was appointed only one of the executors [others named] of her husband's will, and is therefore not liable for the full sum claimed from her and her children. The pursuers contest this. The lords have assigned 26 February for a further hearing. All relevant documents must be produced. [Signed]: Ro. Scot. Notarial sign. [Very dirty and faded] Edinburgh, February 1605. (ii) Two notes [in different hands]: ? the will and/or other documents were produced by the procurator [? s] for inspection.
