Description

Documents concerning legal proceedings: Archibald Inglis and others against Robert Lumsden. (ff. 81-84): Royal order to [blank], sheriffs in hac parte. Elizabeth Gray, widow of Patrick Kinnaird of Inch [? ture] and now wife of William Gray [cf. f.87], isto be summoned to a hearing on 24 November; also Alexander, master of Elphinstone, our treasurer, Master Thomas Hamilton, our familiar clerk and councillor, advocate for the Crown's interest, and William Gray, 'our pretendit donatori' to the gift of escheat which is disputed by George Kinnaird. Open proclamation is to be made at the market cross of Perth that all interested parties should also attend the court. All relevant documents must be produced, since the lords of council and session intend to rescind them because a) Kinnaird claims that he never molested the Grays, his eldest brother's widow and her present husband, and indeed could not have done so, since William Gray is the son of the powerful Patrick, Lord Gray, while Kinnaird is only a yeoman farmer. The summons was delivered at his house before daylight, and the proclamation at the market [? cross] of Perth made on the same day before he had opportunity to reply. By act of parliament only earls have to find sureties of £2,000; for yeomen the amount is 100 marks. The Grays have tried to impede the finding of a surety, in order to continue Kinnaird's status as a rebel but, Andrew Moncur of Moncur having now agreed to become his surety in £1,000, Kinnaird is now legally exempt from the letters of horning. b) It appears that at least one of the Grays has lied under oath about the molestation. If they do not appear, justice will be administered in their absence. Witnesses [unnamed] are also to be summoned. [Signed]: James. 'quinto Nov.'. Robert Gairdnar. Seal. Notarial sign. [Endorsed]: 1. By Thomas Man, 'messinger sheriff in that part'. On 8 November he summoned Alexander, master of Elphinstone and Master Thomas Hamilton at their dwelling-places in and near Edinburgh by affixing copies of the summons there. Three witnesses [named] to his actions. [Seal, said to be affixed, now missing]. 2. By Man. On 13 November he summoned Elizabeth and William Gray by affixing copies of the summons to their dwelling-place. On the same day he issued a proclamation at the market cross of Perth, requiring interested parties to attend the hearing. Five witnesses [named] to his actions. [Seal, said to be affixed, now missing]. 3. Names [in different hand] of chief parties to the suit. Dated at Edinburgh.
