Description

Documents concerning legal proceedings: Archibald Inglis and others against Robert Lumsden. (ff. 81-84): (i) Royal order to George Bell and John McLaren (McLawren), sheriffs in hac parte. The royal advocate in the following suit is Master Thomas Hamiltonof Drumcairn. William Gray of Inch [? ture] is donatory of the escheated property of George Kinnaird of [? Elderslie], put to the horn on 19 July last as a rebel following his alleged refusal to find legal surety of £2,000 against molestation of Gray and his wife Elspeth [elsewhere Elizabeth]. As the Crown granted the property to Gray on 20 July, it now pertains to him. Kinnaird is to be personally summoned, and all others having or pretending an interest in the matter required by open proclamation at the market crosses of Perth and elsewhere to appear before the lords of council and session on 15 November. Witnesses [unnamed] are also to be summoned. [Signed]: [? H.] Wardlaw. Seal. Notarial sign. [Dirty and torn]. Edinburgh, 22 July 1599. (ii) Notes ? assigning dates for further hearings. [Endorsed]: 1. By George Bell. On 21 October he summoned Kinnaird by affixing a copy of the summons to the gate of his house in 'the Rawes'. Three witnesses [named] to his action. Seal. 2. [In same hand as 1.] By John McLaren. On 23 October, at the market cross of Perth, he charged all interested parties to appear. Several witnesses [named] to his action. Seal. 3. [In different hand] 'Deliverit to Patrik Kynnaird the [?] of horning producit in this proces xi [? November] 1600'. [Signed]: Patrik Kynnaird. 4-7. Four fragmentary notes [in various hands, some virtually illegible]. One, dated at Perth 16 November 1599 and [? signed by Thomas Hamilton], apparently assigns the following Friday for a further hearing. 23 [?July], 6 November, 19 December [1599], and one or more illegible dates
