Documents concerning legal proceedings: Archibald Inglis and others against Robert Lumsden. (ff. 81-84): Royal order to Thomas McKinsack (Makessak) and [blank], sheriffs in hac parte. A suit has been begun by Walter Ross Johnson of Tain [cf. ff.56, 57] against George Ross of Balnagowan, Alexander Ross, Thomassone Wricht of Kincardine and three other defenders [named], charging them with having violently and illegally evicted him from his land in the 'kirktoun' of Kincardine in the earldom of Toss and sheriffdom of Inverness, which he has held as takman [taxman] with tenure of some years yet to run, and having withheld from him all its annual profits. The lords of council and session have assigned 6 November for a further hearing. The sheriffs are to summon witnesses [unnamed] to appear. [Signed]: [? Tho./Jo.] Mawer [? s]. Seal. Notarial sign. [Followed by, in different hand]: [? Executed] 'the penult. of October 1598 before thes witnesses, George [? Graeme] and' [Several illegible words]. [Endorsed]: 1. By McKisack. On 30 October he personally summoned George Ross of Balnagowan, and gave him a copy of the summons. Three witnesses [named], including George Grahame, to his action. [Seal, said to be affixed, now missing]. 2. By McKisack. On 31 October he personally summoned witnesses [named]. Three witnesses [named] to his action. [Seal, said to be affixed now missing]. 3. [In different hand]: By John Scott [? Stott], sheriff in hac parte. On 31 October he personally summoned other witnesses [named]. Three witnesses [named] to his action.
