Description

Documents concerning legal proceedings: Archibald Inglis and others against Robert Lumsden. (ff. 81-84): (i) Royal order to Archibald Edgar, 'messinger' and [blank], sheriffs in hac parte. Robert Lumsden, merchant, burgess of Edinburgh, is to be summonedto appear before the lords of council and session on 1 November to answer the charges of Archibald Inglis and his tenants [six named, including Janet Sinclair, Lady of 'Bulberdene'], who have received a decree from the lords, dated 3 March 1595 and now suspected to have been in error, ordering them to vacate property in Eymouth in the barony of Coldingham and sheriffdom of Berwick. Lumsden claims that the persons concerned could not find sureties. The lords require him to show why the former decree should not be rescinded. If he does not appear the lords will give judgment in his absence. Witnesses [unnamed] are also to be summoned. [Signed]: James. 9 Julij. A. Schaw. Seal. Notarial sign. Edinburgh, 5 July 1597. (ii) Several marginal notes [in different hand, virtually illegible], registering decision [? s] by the lords ? that the case for revocation should proceed. 2-3 January 1598. (iii) [Followed by] 'Mr. Blinsele' [several illegible words]. [Endorsed]: 1. By Archibald Edgar. On 11 July he proclaimed the order summoning Lumsden at the market cross of Edinburgh and affixed a copy there. [Signed]: Archibald Edgair. Seal. 2. By James Wilson (Willsoun). On 12 July, failing to find Lumsden, he affixed a copy of the summons to the door of his house in Edinburgh. Two witnesses [named] to his action. [Signature blotted]. Seal. 3. [In different hand from 1]: By Edgar. On 23 November he summoned Laurence Olyphant and Robert Dawbney to appear as witnesses. Two witnesses [named] to his action. Seal. 22 December 1597
