Documents concerning legal proceedings: John Maxwell against William [Maxwell], Lord Herries. (ff. 71-77): Royal order to Robert Maxwell and James Hurstam [? s], 'messingers and sheriffis' in hac parte. The lords of council and session have assigned 13 July for the pursuer to prove his case. Seventeen witnesses [named] are to be summoned to attend. If the defender, after due summons, does not appear, the lords will assume that he confesses his guilt, and will give judgment accordingly. [Signed]: James. J. Hay. Seal. Notarial sign. [Endorsed]: 1. By Robert Maxwell. On 8 July he personally summoned Lord Herries, and gave him a copy of the summons. Three witnesses [named] to his action. Seal. 2. By James Hurstam [? s]. On 12 July he personally summoned ten of the named witnesses [The remaining names crossed through]. Five witnesses [named] to his action. Seal. Dated at Edinburgh.
