Documents concerning legal proceedings: John Maxwell against William [Maxwell], Lord Herries. (ff. 71-77): Royal order to John Maxwell and James Hurstam [?s], sheriffs in hac parte, reciting details of the Maxwell-Herries suit. [The commissary's decree is here dated 6 August 1593; cf. f.71]. The lords of council and session have assigned 27 June for a further hearing. The defender and five witnesses [named] are to be summoned to attend. [Signed]: James. J. Hay. Seal. Notarial sign. [Endorsed]: 1. By John Maxwell. On 21 June he summoned Lord Herries at his temporary dwellingplace at Caerlaverock by knocking six times on the gate and affixing a copy of the summons there. Three witnesses [named] to his action. Seal. 2. By James Hurstam [? s], 'messinger, ane other of the sheriffs'. He has personally summoned the five required witnesses [named] to attend. Five witnesses [named] to his action. Seal. [Followed by] Several fragmentary notes [virtually illegible, as very faded], one dated 1 July 1594 and another containing the name of John Maxwell. Dated at Edinburgh.
