Documents concerning legal proceedings: John Maxwell against William [Maxwell], Lord Herries. (ff. 71-77): Royal order to Edward and John Maxwell, sheriffs in hac parte. They are to summon Lord Herries, claiming to be executor for his mother Lady Agnes Herries [died 14 March 1594], who was executrix for her daughter Lady Mary Maxwell [Lady Hay of Yester], to appear before the lords of council and session on 21 May to answer at the instance of John Maxwell, son of Edward Maxwell of Stonehous [? Stonehouse, Lanarkshire], and to see a decree by Master Homer Maxwell, commissary of Dumfries, dated 15 August 1593, requiring Lady Herries to pay the pursuer within fifteen days £200 owed to him by Lady Mary Maxwell, who died in October 1592. Lord Herries is to pay this sum or make answer. If he does not attend, the lords will proceed to administer justice. Witnesses [unnamed] are also to be summoned. [Signed]: Ro. Gairdnar. Seal. Notarial sign. . (i) Edinburgh, 18 April 1594. (ii) Marginal note [in different hand]: Owing to absence of [?], the case is to be continued. [Endorsed by] John Maxwell, 'executour withinwrittin'. On 29 April he personally summoned Lord Herries. Three witnesses [named, all Maxwells] to his actions. Seal. [Followed by] Fragmentary notes [in different hands], one giving the names of parties to the suit. 18 June 1594
