Description

Fragments and miscellanea in the judgement of appeal between John Parker and others and John Fynchyngfeld, clerk, the cause is not fully stated, but appears to rest on an action brought in the Court of Chivalry by Idonea Hert, executrix of Robert Greenacre, knight, and William Hert, citizen and baker of London, by then deceased, concerning a monetary contract made in Bordeaux. There are also two documents from a long-running dispute over the ransom of the Count of Denia, an Aragonese nobleman of the blood royal of Castile, captured at Najera in 1367. Denia himself returned to Spain, leaving his son as hostage for payment of the ransom: although, since letters of marque were issued for reprisals against Aragonese shipping in 1391-1393, much of that ransom may never have been paid. Entitlement to the ransom was disputed between John Hoton, assignee of the widow one of the original captors, Robert Hauley, and John Shakell, effectively the other captor by virtue of brotherhood in arms. The case first came before the Court of Chivalry in 1390, and with repeated adjournments, appeals by Shakell, and new commissions, continued to 1397. Judgement was given against Shakell (who had died in 1396) early in the reign of Henry IV, and certainly before July 1401. Thomas Stokes, executor of Shakell, appealed against the decision, and it may be that appeal which prompted a certiorari and the fragmentary return. Further appeals were made between 1409 and 1412. In 1410 Hoton's executors and assigns petitioned the king for execution of the sentence; and it is the further assignment of their interest to Humphrey Duke of Gloucester that lead in turn to proceedings in 1432 before John Duke of Bedford as constable. Also includes an imperfect record of this action, and the sentence given by Bedford in favour of his brother. (Described at item level)
