Description

Short title: Waterman v Rudiard.

Plaintiffs: Philip and Alice Waterman.

Defendants: William Rudiard and John Buxton.

Documents: depositions concerning inheritance rights in Heathcote, Hartington, Derbyshire.

Taken 18 April, 13 James I.

Deponents for defendants: John Humbleton of Heathcote in the parish of Hartington, yeoman, aged 74, whose memory goes back 60 years [to 1555], deposed that in the absence of a male heir lands were transferred in their entirety to the eldest daughter unless a wife survives [female primogeniture]; Richard Goodwin of Hurdlow, parish of Hartington, yeoman, aged 60, deposed that the only exception to the custom of inheritance existed in the event that the inheritor was in jail or over seas 'or of non sane memorie or a woman under covert Baron' [or of not sane memory or a woman under covert baron]; John Wolley of Heathcoate, yeoman, aged 60, whose memory goes back 'always' [to 1555]; William Fearne of Heathcote yeoman, aged 40; Thomas Mason of Hartington, yeoman, aged 50.
