Description

Short title: Fullwood v Burgen.

Plaintiffs: Francis Fullwood.

Defendants: Roger Burgen.

Documents: depositions concerning Matlock, Derbyshire.

Deponents for plaintiffs: William Walker of Wirksworth, husbandman, aged 50, deposed that Roger Burgen, 12 months ago, bargained with George Walker for the inheritance of lands in Matlock, worth £12 per annum, for £120 and other considerations were agreed. Burgen went on to sell the lands for £150. George Walker told William Walker that Burgen has dealt 'unhonestly' with him by selling the land. George Walker had been promised a chamber over the buttery for the rest of his life and Burgen's daughter, being married to Edmund Walker, promised to George Walker 'such meat as her husband and shee had at all times' during his life and it was agreed that Burgen would not sell or alienate the land but leave the same to his children. It was agreed that Burgen's son without any children would have the land with his wife until Burgen's daughter, Marie Walker, was to inherit; Anthony Haskim of Bowood, yeoman, aged 56; Thomas Fulwood of Middleton, gentleman, aged 40; Thomas Alsopp of Matlock, yeoman, aged 39.

Deponents for defendants: Thomas Sachaverell of Derby, merchant, aged 40; John Ire of Crich, yeoman, aged 57; John Cley of Crich, gentleman, aged 46; George Radford of Crich, yeoman, aged 73.
