Description

Short title: Agard v Smethwick.

Plaintiffs: Charles Agard.

Defendants: [Thomas] Smethicke, William Latham, Richard Shore, Hobson and Holme.

Documents: depositions concerning the ownership of Smerrill Grange, Wirksworth, Derbyshire, once held by the Vernons now held by John Manners.

Taken 28 April, 40 Eliz.

Deponents for plaintiffs: John Lyon of Pype Rydware, Staffordshire, yeoman, aged around 55; Henry Sheldon of Holmesfield, yeoman, aged 76, deposed that he had been bailiff to Sir George Vernon, knight, now deceased. The Vernons had held Smerrill Grange and leased it to Nicholas Agard, uncle of defendant but the land was now held by John Manners; William Tunley of Middleton-by-Youlgreave, aged 80 years and more, deposed that he remembers Sir Thomas Cockayne and now Edward Cockayne, esquire, receiving rents for a sheepwalk in Smerrill as lords of Middleton-by-Youlgreave. He remembers the jury of Middleton-by-Youlgreave sometimes walking the bounds of Wirksworth wapentake along the sheepwalk and says that the jury of Hartington ought not to claim it as theirs; Martin Fayles of Bakewell, yeoman, aged 4 score and 5 [85 years]; William Goodwin of Middleton, husbandman, aged around 50; Richard Heatherly of Middleton, husbandman, aged 3 score and more [60 years and more]; John Tomlinson of Middleton, husbandman, aged around 3 score [60 years].

Deponents for defendants: Edmund Mason of Cole Eaton aged around 70; Roger Webster of Biggin, husbandman, aged around 80; Robert Dakyn of Ravensdale Park, parish of Mugginton, husbandman, aged around 64; Agnes Waterfall of Biggin, widow, aged around 80, deposed that she remembers her father asking permission of the 'heardman' of Biggin to pasture sheep in Frydendale; Richard Bennet of Mapleton, husbandman, aged around 78; Richard Bennet of Biggin, husbandman, aged around 74; Thomas Hombleton of Thorpe, husbandman, aged around 60.
